Progress Terms of Service

These Terms apply to Progress: Photo Journal ("Progress"), provided by Textual, LLC, San Francisco, California, United States ("Textual," "we," "us," or "our"). Contact us at info@textual.studio.

Please read these Terms before using Progress. These Terms describe the conditions for using Progress alongside Apple’s applicable TestFlight terms and app license. If you do not agree, do not use Progress. You must be at least 18 years old and legally able to enter this agreement.

1. The app and its license

Progress helps you capture, organize, and compare personal progress photos and optionally record measurements. Available features can vary by device, operating system, app version, and purchase plan.

The license for the App Store application is governed by Apple's Standard End User License Agreement ("Apple Standard EULA"). These Terms supplement that license with Progress-specific service and purchase terms; they do not replace it or restrict rights granted by Apple's applicable usage rules. If these Terms conflict with the Apple Standard EULA on an app-license matter, the Apple Standard EULA controls. Mandatory consumer law always applies.

Textual is responsible for the Progress services described here. Apple operates the App Store and its payment services under Apple's terms. Contact Textual for Progress support and Apple for Apple Account or App Store billing assistance.

2. Your photos belong to you

You keep ownership of your photos and other content. Using Progress does not give us ownership of them or permission to sell them, publish them, use them in advertising, or train machine-learning models with them.

You authorize the app to store, process, and display your content on your device as needed to perform the features you choose, and to send copies to destinations you expressly select, such as Apple Photos or Apple Health. This is limited permission to operate the product, not a general license to exploit your content.

Only capture or import material you have the right to use. Obtain appropriate permission from anyone you photograph. Do not use Progress for unlawful content, nonconsensual intimate images, harassment, or violations of another person's privacy or intellectual-property rights. Do not interfere with the app's security or bypass purchase controls, except to the extent applicable law expressly permits your activity.

3. A journal, not medical advice

Progress is for personal documentation and general wellness. It does not diagnose, treat, cure, or prevent disease, provide medical advice, or replace a qualified health professional.

Photo alignment and pose suggestions are visual aids. Lighting, clothing, posture, camera position, and detection errors affect comparisons. Photos and any experimental estimates cannot reliably establish a medical condition, precise body composition, or the cause of a physical change. Do not use them to make medical or treatment decisions. Measurements imported from Health or entered by you can also be incomplete or inaccurate.

Use capture features in a safe place and stop any pose or activity that causes pain or discomfort. Progress does not require or promise a particular weight, appearance, or physical result.

4. Storage, copies, and privacy

Our Privacy Policy explains how information is handled. It is a notice of our practices; accepting these Terms does not substitute for consent required for optional permissions or sensitive-data processing.

Your Progress library is stored locally. We do not operate a cloud copy that we can restore for you. Device loss, app deletion, storage failure, or other problems can result in data loss. Keep independent copies of photos that matter to you and review your device backup settings. We do not promise uninterrupted access, permanent storage, or successful recovery in every circumstance. This does not limit our obligations under applicable law.

Optional Apple Photos copies and Apple Health records are separate from your Progress library. Deleting or changing content in one place does not necessarily change the others. Apple and other services have their own terms and settings.

5. Beta access and future purchases

This TestFlight beta has no purchases or subscriptions. Beta builds can expire or become unavailable under Apple’s TestFlight rules. Participation does not promise free access to a future paid version. If paid features are introduced, prices and purchase terms will be presented before any purchase. We will not charge you automatically for participating in this beta.

6. Changes and availability

We may maintain, improve, or change Progress, including to address security, compatibility, or legal requirements. We do not promise particular future features or support for every future operating system.

If we plan to discontinue Progress or materially reduce a paid service during a prepaid period, we will provide reasonable advance notice where practicable and honor applicable rights to continued service, cancellation, or a refund. Urgent security or legal needs may require faster action. This section does not authorize us to erase your local library remotely.

You may stop using Progress at any time. Cancel an active subscription separately through Apple if you do not want it to renew. Termination of the app license is governed by the Apple Standard EULA. Obligations that by their nature continue, including accrued payment obligations and applicable dispute provisions, survive termination.

7. Responsibility and consumer protections

We aim to provide a reliable app, but we cannot promise that every feature will always be available or error-free. The Apple Standard EULA governs app-license warranties and liability, subject to mandatory law. These supplemental Terms do not add a separate liability cap, indemnity obligation, or exclusion of your statutory rights.

Nothing in these Terms excludes liability or limits remedies that cannot lawfully be excluded or limited, including applicable consumer guarantees and rights relating to fraud, intentional misconduct, or personal injury. We remain responsible for obligations the law places on us.

8. Resolving concerns

Please contact info@textual.studio if something goes wrong so we can try to resolve it. Contacting us first is encouraged, not a condition of exercising a legal right or meeting a filing deadline.

For disputes about these supplemental Terms, California law applies, except where mandatory law requires otherwise. You retain any mandatory protections of the law where you live and may bring claims in any court available under applicable law. These Terms do not impose mandatory arbitration or a class-action waiver. Disputes governed by the Apple Standard EULA remain subject to its applicable provisions.

9. Updates to these Terms

We will update the effective date when these Terms change. We will give reasonable advance notice of material changes, except where urgent legal or security needs require otherwise, and request renewed acceptance where appropriate or required by law. Changes do not retroactively remove accrued rights or alter a past purchase. If you decline new Terms, we will explain the effect on continued use and honor applicable rights for any prepaid service.

If a provision cannot be enforced, the remaining provisions continue to apply to the extent lawful. Our failure to enforce a provision immediately does not waive it.
